Article 1 - SCOPE AND PRE-CONTRACTUAL INFORMATION

The present general terms of sale (the “GTS”) apply to the sale of the products (the “Products”) of the company LES ATELIERS DE CORDIZ (“Les ATELIERS DE CORDIZ”) to the company’s consumer clients (the “Clients”) on the company’s website (the “Website”).

No special clauses may, without prior and written acceptance by LES ATELIERS DE CORDIZ prevail on the GTS, so that all the contrary conditions imposed by the Client will, in the absence of prior and written acceptance by LES ATELIERS DE CORDIZ, be unenforceable.

LES ATELIERS DE CORDIZ reserves the right to change at any time the GTS, and the changes made are then applicable to orders placed after they have been uploaded on the website.

Any order implies the pure and simple acceptance of the GTS.

The Client declares to have read the information listed in the article L.221-5 of the French Consumer Code, and in particular:

- the information on the identity and full contact details of LES ATELIERS DE CORDIZ;

- the essential characteristics of the Products offered for sale;

- the price of the Products and the payment terms;

- the terms of delivery and the handling of complaints;

- the procedures for exercising legal guarantees related to the Products;

- the terms and conditions for exercising the right of withdrawal and the form drawn up for this purpose for orders off-premises as defined herein.

The GTS are written in French which is the only valid language, the French law governs the relations with the clients.

LES ATELIERS DE CORDIZ are not able to accept orders to be delivered outside the European territory, or in the French overseas departments, territories and communities.

Article 3 – Products

The Products to be sold by LES ATELIERS DE CORDIZ are described and displayed on the website.

Although LES ATELIERS DE CORDIZ make every effort to ensure that the photographs on the Website are faithful and updated replicas of its Products, the Client is expressly informed that such photographs and illustrations are given solely for information and cannot therefore constitute a contractual commitment, nor any guarantee from LES ATELIERS DE CORDIZ about the perfect similarity between the Products ordered by the Client and the photographs and illustrations on display on the Website.

In particular, the Client is expressly informed that variations in colour may occur depending on the system and information technology equipment used by the Client, as well as due to the colour-specific technical and sharpness characteristics of the photographs and illustrations on the Website.

In any case, the Client should contact LES ATELIERS DE CORDIZ using the contact details mentioned at article 2 above for any question and/or further information about the Products.

Article 4 – ORDERS – CREATION OF THE SALE AGREEMENT

For any order of Products on the Website, the Client needs to follow the steps below, the order of which may vary depending on the updates and technical constraints of the Website.

1. Type the address of the Website.
2. Select the desired Products.
3. Check the elements of the order and, if necessary, identify and correct any omissions and errors.
4. Validate the order, the total price all taxes included, as well as, if necessary, the processing and delivery costs mentioned during the order.

1. Fill out, according to the indications displayed, the order form and in particular the information necessary for his/her identification such as his/her last name, first name, postal address, email address, delivery address and billing address.

The Client is responsible for the accuracy and completeness of the information entered on the Website, so that LES ATELIERS DE CORDIZ cannot be held responsible for any defect, delay and/or non-conformity of delivery related to deficiencies or errors in the information entered.

1. Follow the instructions of the online payment server to pay the price including all taxes and ancillary costs.

1. Validate the order definitively, according to the summary displayed on the screen, by clicking on the tab “confirm the payment” to show his/her commitment, knowledge and acceptance of the GTS and the purchase made.

1. The Client then receives electronically a confirmation of acceptance of payment of the order.

If the debit of the price All Taxes Included and all fees included is impossible, the online sale will be immediately resolved ipso jure and the order cancelled, without the Client being able to make any claim in this respect.

At the end of the order process, the Client is recommended to download, save and/or print the GTS, as well as the information relating to the order placed.

From its validation, the order is submitted to LES ATELIERS DE CORDIZ for processing and cannot be cancelled or modified anymore by the Client, subject to the conditions relating to the right of withdrawal referred to in Article 8 below.

An order confirmation email summarizing the details of the order accompanied by the GTS is sent to the Client to the email address that he/she communicated when ordering.

Article 5 – ORDERS – AVAILABILITY OF THE PRODUCTS

The offers of products and the prices proposed by LES ATELIERS DE CORDIZ are available for as long as they are accessible on the Website and only within the limit of the available stocks.

If one or more of the Products ordered are not available, the Client will not be able to finalize his/her order.

Article 6 – PRICE AND MEANS OF PAYMENT

1. Price

The prices of the Products are indicated on the Website in Euros (€) and are to be understood as including all taxes, considering the VAT rate applicable on the day of the order.

The processing and delivery costs are the responsibility of the Client and are indicated according to the shipping options chosen by the Client according to the indications of the price.

LES ATELIERS DE CORDIZ reserve the right to change their prices at any time, it being understood that orders for Products will be charged on the basis of the rates in force at the time of the registration of each order, as they appear on the Website.

1. Payment

Orders placed on the Website may only be paid for their total amount including all taxes by credit card through the secure payment system of the Client’s bank or via the PayPal portal.

The commitment to pay by means of a payment card or PayPal account is irrevocable.

Article 7 – DELIVERY OF PRODUCTS

Delivery times are determined by LES ATELIERS DE CORDIZ depending on the availability of stocks, the nature of the order, the preparation and shipping time of the order and the period of activity.

Delivery times will not be less than ………………. days from receipt of the order.

When the Products must be pre-ordered, the delivery times are automatically increased by those indicated in their description on the Website.

Les ATELIERS DE CORDIZ may divide an order into several shipments depending on the availability of the Products.

The deadlines are indicated when placing the order; LES ATELIERS DE CORDIZ nevertheless undertake to make their best efforts to deliver the Products ordered in the shortest time possible.

Except in cases of force majeure defined by article L.1218 of the Civil Code, if the Products are not delivered within the deadlines communicated by LES ATELIERS DE CORDIZ, the Client may request in writing the resolution of the sale under the terms and conditions of articles L.216-6 and L.216-7 of the Consumer Code.

Any modification of the order accepted by LES ATELIERS DE CORDIZ will necessarily result in an extension of delivery times. Similarly, the delivery of the Products may only be postponed at the Client’s request upon prior written agreement given by LES ATELIERS DE CORDIZ.

The Client is required to check the condition of the packaging of the Products and the conformity of the Products delivered upon receipt.

The Client must in particular express his/her reservations and complaints, as soon as he/she has found an anomaly such as a damaged parcel or packaging, a Product missing as compared to the documents attached to the delivery.

In case of non-compliance of the Products in kind or quality, the Client must inform the customer service of LES ATELIERS DE CORDIZ using the contact details referred to in Article 2 above.

Article 8 – LEGAL RIGHT OF WITHDRAWAL

8.1. Conditions for exercising the statutory right of withdrawal

The Client has a period of fourteen (14) days to exercise his right of withdrawal, without having to justify his/her decision or pay penalties in accordance with the provisions of article L.221-18 of the Consumer Code.

This period begins to run from the receipt of the Products by the Customer.

If this period expires on a Saturday, Sunday or public holiday, it will be extended until the next working day.

To notify to LES ATELIERS DE CORDIZ his/her decision of withdrawal, the Client will send by mail or by email to LES ATELIERS DE CORDIZ:

• the withdrawal form accessible on the Website duly filled in;

or

• an unambiguous statement as to his/her intention to withdraw;

The Client who exercises his right of withdrawal is obliged to return the Products received to LES ATELIERS DE CORDIZ no later than fourteen (14) days after notification of the decision to withdraw.

8.2. Return of the products

In case of exercise of the right of withdrawal, the Client must return the ordered Products, in their packaging and in perfect state of conservation, to LES ATELIERS DE CORDIZ, or to any person designated by the latter, without undue delay and, at the latest, within fourteen (14) working days following the day of the communication of his/her decision to withdraw.

The Client bears the direct costs and expenses related to the return of the Products.

The Client may be held liable in the event of degradation of the Products resulting in particular from abnormal and excessive manipulations.

8.3. Refund

In case of exercising the right of withdrawal, LES ATELIERS DE CORDIZ will reimburse the Client for all amounts paid, including delivery charges, with the exception of additional costs arising from the fact that the Client has chosen, where applicable, a mode of delivery other than the cheaper standard delivery mode.

LES ATELIERS DE CORDIZ will refund the sums paid, at the latest, within fourteen (14) working days following the day on which they are informed of the withdrawal decision.

LES ATELIERS DE CORDIZ reserve the right to postpone the refund until (i) receipt of the Products or (ii) proof of shipment of the Products, the date chosen being that of the first of these dates.

LES ATELIERS DE CORDIZ will refund the sums using the same means of payment used by the Client for the order.

Article 9 – TERMS OF USE OF THE PRODUCTS

The Client is required to respect any instructions and precautions for use and maintenance of the Products, as set out in the description on the Website and in the instructions accompanying the Products.

LES ATELIERS DE CORDIZ shall not be held liable for any damage resulting from use or maintenance contrary to the instructions and precautions communicated.

Article 10 – LEGAL GUARANTEES OF CONFORMITY AND HIDDEN DEFECTS

 

 

Article 11 – INTELLECTUAL PROPERTY

LES ATELIERS DE CORDIZ remain the owners of all intellectual property rights as results of the work carried out for the supply of the Products to the Client, such as photographs, presentations, studies, drawings, models, plans made for the supply of the Products as any other element included on their website. It is prohibited for the Client to proceed to any duplication or exploitation of the said work, without the express, written and prior authorization of LES ATELIERS DU CORDIZ, which may oblige him/her (the Client) to pay a financial compensation.

Article 12 – PERSONAL DATA – EVIDENCE AND ARCHIVING

In order to provide the Products to the Client, LES ATELIERS DE CORDIZ collect and process the following personal data (hereinafter referred to as "personal data") concerning the Client: 

-  Last name, first name;

-  Mailing address;

-  Email address;

-  Fixed and/or mobile phone number;

-  Bank details;

Personal data is stored by LES ATELIERS DE CORDIZ under adequate security conditions for the period necessary for the purposes pursued, and in particular for the following periods:

-  if a contractual relationship is concluded between LES ATELIERS CORDIZ and the Client, the data collected for the purpose of concluding and executing this contractual relationship are kept for the duration of the contractual relationship and then for a period of five (5) years after the termination of it - in accordance with the statutory limitation period in contractual matters;

- the personal data on the accounting documents of LES ATELEIRS DE CORDIZ are kept for a period of ten (10) years following the year in which these documents were drawn up;

-  the e-mail address provided to receive promotional offers and newsletters from LES ATELIERS DE CORDIZ is kept until unsubscribed by the link provided for this purpose, any prior processing remaining lawful.

The controller of the processing of the personal data is the company LES ATELIERS DE CORDIZ which can be contacted directly at the contact details indicated in Article 2.

The information and data entered by the Client on the purchase orders are compiled and collected by LES ATELIERS DE CORDIZ only for the purposes of processing, preparing, and delivering the Products ordered.

This information and data may be collected and stored in a customer file kept by LES ATELIERS DE CORDIZ in accordance with the regulations on personal data.

The Client has the right to access, rectify, modify and delete, limit and transfer his personal data at any time.

The Client may exercise these rights by contacting LES ATELIERS DE CORDIZ to the following e-mail address  _________.

The Client also has the right to lodge a complaint with the CNIL or any competent judge.

Article 13 – SETTLEMENT OF DISPUTES

For any dispute relating to the validity, interpretation, performance, non-performance, interruption and/or termination of these GTS and Product sales, only the French courts will be competent and determined in accordance with the French rules of civil procedure.

Any complaint must be addressed by the Client by registered letter with acknowledgement of receipt to the customer service of LES ATELIERS DE CORDIZ to the address mentioned in article 2 above.

If the Client is not satisfied with the complaint, the Client is informed of the possibility of submitting the dispute to mediation.

This mediation procedure, which is not a mandatory prerequisite before the initiation of a dispute, is only intended to try to bring the parties together in order to reach an amicable solution.

In consequence, LES ATELIERS DE CORDIZ and the Client are free to accept or refuse the use of mediation, as well as to accept or refuse the solution proposed by the mediator.
